These terms and conditions apply to the use of this website at theclassiccamera.com By accessing this website and/or placing an order, you agree to be bound by these terms and conditions. Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, do not use this website.
1.1 You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.
2. ORDERING FROM US
2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. When we dispatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order: (a) where goods are not available; (b) where we cannot obtain authorization for your payment; (c) if there has been a pricing or product description error; or (d) if you do not meet any eligibility criteria set out in our terms and conditions.
3.1 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
3.2 Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this Website.
3.3 Our prices are reviewed periodically and the next review will be on 01/06/2009.
4. CANCELLATION AND RETURNS POLICY
4.1 If you wish to cancel your order: (a) you can notify us by email to email@example.com before we have dispatched the goods to you; or (b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.
4.2 You can return goods you have ordered from us online or over the phone for any reason at any time within 14 days of purchase for a full refund or exchange. The costs of returning goods to us shall be borne by you.
4.3 Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required.
4.4 Items purchased in person at our London shop are not eligible for a refund unless faulty as per the 1979 Sale of Goods Act. If in the unlikely event of experiencing dissatisfaction with a purchase made in the shop, an exchange or credit note may be given within 7 days of purchase at the manager’s discretion.
4.5 Whether purchased online or in person all goods must be returned to us in the condition that they were supplied. All packaging and goods must be returned as new and in a salable condition. Any warranty and/or passport applications must be unmarked. The rights to return the goods to us as referred to in clauses 4.2, 4.3 and 4.4 will not apply if these criteria are not met. The provisions of this clause 4.5 do not affect your statutory rights.
5. REPAIRS AND SERVICING
5.1 The Classic Camera will perform repairs according to standardised requirements at a lump-sum price. The lump-sum price is determined to the best of our knowledge on the basis of the examination of the object to be repaired with measuring devices as usual in this line of business, and is notified to the Customer in the form of a cost estimate. The services rendered for submission of the cost estimate are charged to the Customer if agreed in the individual case. The cost estimate and the underlying repair prices cease to be valid if the order is released towards The Classic Camera later than three months of the date of the cost estimate.
5.2 If during the repair works it turns out that the object cannot be successfully repaired with the standardised means and procedures taken as a basis for the cost estimate, The Classic Camera will notify the Customer accordingly by submission of a new cost estimate. If the Customer requests return of the object to be repaired without change, The Classic Camera will return the same together with an invoice for its expenses. These expenses also include the costs for the preparation of the cost estimate. If the Customer requests repair, The Classic Camera will perform such repair on the basis of the new cost estimate.
5.3 The Classic Camera is entitled to use reconditioned and quality-checked components for repair, unless the Customer expressly in writing insists on the use of brand-new parts.
5.4 If The Classic Camera must use a spare part within the scope of the repair which changes the external appearance of the object to be repaired, The Classic Camera will beforehand inform the Customer thereof by a corresponding indication in the cost estimate.
5.5 The condition of equipment – until received, remains the risk and responsibility of the sender. Appropriate notification will be given of any package which appears externally damaged and suffered in transit. If there is no evidence of external damage, notification of general wear and tear of equipment, internal damage, or the cosmetic condition of the equipment therein, may be excluded from our notification and referred for technical examination and subsequent report.
5.6 If any equipment within reasonable period of time (six months), is not claimed / retrieved by customer, or if any equipment sent to us, the source of which cannot be determined, or if any item cannot be delivered for reasons whereby we are not at fault, we are not obliged to store such equipment further. Subsequently, having provided reasonable and due recorded notification, we are exempt from any liability and entitled to dispose of said equipment, in a manner required to recover any costs or handling / storage charges, that may be due or incurred.
5.7 Equipment left with us in excess of six months, particularly after due notification has been served, will be subject of an obligatory examination – regardless of equipment’s repair status. Any additional costs which may subsequently arise, will be required to be met by the sender / owner of equipment, upon return.
5.5 All repairs are guarenteed against failure of repaired parts for a period of 6 months from date of repair unless otherwise stated.
6.1 You are permitted to print and download extracts from this Website for your own use on the following basis: (a) no documents or related graphics on this Website are modified in any way; (b) no graphics on this Website are used separately from accompanying text; and (c) any of our copyright and trade mark notices and this permission notice appear in all copies.
6.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licencors. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 6.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.
